Overstayed Your Visa in India? Here’s What You Can Do

Overstayed Your Visa in India? Here’s What You Can Do

If you are in India on a foreign passport and your visa is about to expire, do not wait until the last day.

Whether you are staying because of a medical emergency, family situation, cancelled flight, or simply need more time, there may be options available depending on your visa and circumstances.

If your Indian visa has already expired, you may need to address the overstay with the appropriate immigration authorities before leaving India.

What Happens If You Overstay Your Indian Visa?

Staying in India beyond the period permitted by your visa can result in an immigration violation and may lead to financial penalties or other immigration action.

The consequences can depend on:

  • How long you have overstayed
  • Your visa type
  • Your nationality
  • The reason for the overstay
  • Your individual circumstances

The longer the overstay, the more complicated the situation can become.

What If You Think You Will Overstay?

If your visa has not expired yet, check whether you are eligible to apply for a visa extension.

Visa extension is one of the services available through the Government of India's e-FRRO system.

You may need to provide documents explaining why you need additional time in India, such as:

  • Medical treatment
  • Family emergency
  • Travel disruption
  • Other genuine circumstances

An extension is not automatic. Approval depends on your visa category, circumstances and the decision of the competent authority.

What If Your Visa Has Already Expired?

If you have already overstayed, don't simply ignore the situation or wait until you reach the airport.

You may need to contact the relevant FRRO/FRO or apply through the e-FRRO portal to address your immigration status.

Depending on your circumstances, you may also need an Exit Permit before leaving India.

What Is an Exit Permit?

An Exit Permit is immigration permission that may be required for a foreign national to leave India when there is an immigration issue that needs to be resolved first.

Exit Permit applications are available through the e-FRRO system in applicable cases.

Whether you need one depends on your individual situation and the instructions of the immigration authorities.

What If the Overstay Happened Because of a Medical Emergency?

If you could not leave India because of a genuine medical emergency, keep all supporting documents.

These could include:

  • Hospital records
  • Doctor's letter
  • Medical reports
  • Treatment records
  • Flight cancellation documents

These documents can help explain the circumstances of your overstay when your case is reviewed.

However, a medical emergency does not automatically guarantee a visa extension or waiver of penalties.

Can You Just Leave India From the Airport?

If your visa has expired, don't assume you can simply arrive at the airport and leave normally.

Depending on your situation, you may need to resolve the overstay and obtain the required immigration clearance or exit permission first.

It is better to deal with the issue before your flight.

What Should You Do?

If your Indian visa is about to expire:

  1. Check your visa expiry date.
  2. Find out whether you are eligible for a visa extension.
  3. If your visa has already expired, contact FRRO/FRO or use e-FRRO.
  4. Keep documents supporting the reason for your stay or overstay.
  5. Don't wait until the airport to resolve the problem.
